These Terms of Service (the “Terms”) govern your access to and use of RESnipe, a real-estate research platform operated by Excelsior Technologies (“RESnipe”, “we”, “us”, or “our”). By creating an account or using the service, you agree to these Terms.
1The service
RESnipe deploys automated agents that gather publicly available real-estate information, analyze listing photos, estimate values and returns, and organize the results for your review. The service is a research and productivity tool. It does not provide, and nothing in it constitutes, real-estate brokerage, appraisal, lending, investment, tax, or legal advice.
2Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use RESnipe. Access is currently invitation-based. You are responsible for the activity that occurs under your account and for keeping your login credentials secure. Authentication is handled by our identity provider (Auth0); you may sign in using a supported provider such as Google.
3Credits, billing & refunds
RESnipe operates on a prepaid credit model. Actions such as running a hunt, analyzing a property, running recon, or estimating short-term-rental potential consume credits at the rates shown in the app. Credits are charged only when an action completes successfully.
- Payments are processed by Stripe. We do not receive or store your full card details.
- Credits have no cash value, are non-transferable, and are non-refundable except where required by law.
- Prices, credit costs, and pack contents may change; changes apply to future purchases, not credits you already hold.
- Voice-calling features are available only on eligible plans.
4Acceptable use
You agree not to:
- use the service for any unlawful purpose or in violation of any third party’s rights;
- resell, redistribute, or provide the service or its outputs as a competing product;
- attempt to circumvent metering, security, or access controls, or overload the platform;
- use any automated outbound-calling feature except in compliance with all applicable laws, including telemarketing, do-not-call, and consent requirements (e.g., the U.S. TCPA and analogous rules). You are solely responsible for how and to whom you place calls.
5Data sources & estimates
RESnipe aggregates information from public and third-party sources. Valuations, rent and revenue projections, mortgage and equity estimates, condition assessments, and match scores are automated estimates for informational purposes only. They are generated from limited data (often just listing photos and public records), may be incomplete or inaccurate, and are not a substitute for a professional inspection, appraisal, title search, or your own due diligence. Do not rely on them as the sole basis for any purchase, sale, or financial decision.
6Intellectual property
RESnipe, its software, design, and brand are owned by Excelsior Technologies and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the service under these Terms. Outputs generated for your account may be used for your own internal business purposes.
7Third-party services
The service relies on third-party providers (for authentication, payments, AI models, browsing infrastructure, mapping, and data). Your use may be subject to their terms, and we are not responsible for their acts or omissions.
8Disclaimer of warranties
The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of results. We do not warrant that the service will be uninterrupted, error-free, or that estimates will be correct.
9Limitation of liability
To the maximum extent permitted by law, Excelsior Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the service. Our aggregate liability for any claim will not exceed the amount you paid us in the three (3) months preceding the event giving rise to the claim.
10Termination
You may stop using the service at any time. We may suspend or terminate access if you breach these Terms or use the service in a way that creates risk or legal exposure for us or others. Unused credits are forfeited on termination for cause.
11Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use after changes take effect constitutes acceptance.
12Governing law
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Washington will have exclusive jurisdiction and venue over any dispute arising from or relating to these Terms or the service, unless applicable law provides otherwise.
